Return and Refund Policy

1. State Law Context (Texas)
Under Texas law, there is no specific “puppy lemon law” that automatically gives a buyer a right to a refund if a dog becomes sick after purchase. However, general express and implied warranty rules in the Texas Business & Commerce Code, and consumer protections under the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA), can apply to contracts and representations about the health and condition of a live animal.
2. Sale is Final
All puppy sales are final. We do not offer refunds for personal circumstances, including but not limited to:

Change of heart
-
Housing issues
-
Allergies
-
Lifestyle changes
3. Deposit Terms

A deposit of $500 is required to reserve the puppy.

Buyer acknowledges that deposits are non-refundable.
-
Deposits secure a specific puppy or waiting list placement.

This fee also compensates the Breeder for taking the puppy off the market and for administrative costs.

If Buyer fails to complete the purchase for any reason, the deposit is forfeited.

If Ward’s Frenchies 2 Yours cannot deliver the agreed puppy, the buyer may choose:

A full refund of deposit, or
-
Transfer of deposit to a future litter.

4. Health Evaluation & Notification Requirement
To be eligible for any health-related remedy:

The puppy must be examined by a licensed veterinarian in Texas within 72 hours (excluding weekends/holidays) of possession.

The buyer must notify the breeder in writing within 48 hours of diagnosis if the vet finds a life-threatening congenital condition present at the time of sale.
Required documentation:

Detailed written report from the examining veterinarian

Proof that the puppy was examined within the specified timeframe
5. Remedies for Congenital or Hereditary Conditions
If a veterinarian documents a life-threatening congenital or hereditary condition that was likely present at the time of sale, Ward’s Frenchies 2 Yours may, at our discretion:

Provide a replacement puppy of equal value (if available), or
-
Issue a partial or full refund of the purchase price.
Notes:
-
Veterinary fees are not covered by the breeder.

Remedies are contingent on meeting all notification and documentation requirements.
6. Return of Puppies After Leaving Breeder Care
Once the puppy has left the breeder’s custody:
-
No returns for refunds are accepted solely for buyer convenience.

If the buyer cannot care for the dog at any time, the breeder must be notified first and given first right of refusal for rehoming.
7. Shipping & Delivery Fees
All shipping/travel costs are non-refundable, as third-party carriers are outside the breeder’s control.
8. Registration, Spay/Neuter & Breeding Terms

Pet-only puppies are sold with limited registration.
-
Breeding or resale rights require a separate written agreement.
-
Violations of breeding terms void all guarantees.
9. Buyer Acknowledgement
By purchasing a puppy from Ward’s Frenchies 2 Yours, the buyer indicates they have:
